Support the Government of Kazakhstan in implementing a modernized legal, institutional and methodological framework for economic regulation of infrastructure in Kazakhstan. Development of a detailed tariff regulation methodology and tariff calculation process for the water sector at national level and at the water utility (pilot company level), based on establishment of a Regulated Asset Base (RAB) and calculation of the Weighted Average Cost of Capital (WACC), as well as projections of operating costs based on objective assumptions, replacing the existing, complex and inflexible system of normatives. The assignment included financial modelling and legal and institutional analysis. Advice and assistance provided to the Legal Consultant and Regulator on drafting legislative amendments to laws and secondary legislation and capacity building program supporting the water utility (pilot company).
The overall objective of this assignment is to facilitate the timely and effective implementation of the Project by rendering assistance to the water company in the implementation of the project, which includes detailed design of water supply infrastructure, such as water intakes, water treatment and distribution, procurement for utility machinery and the implementation of the construction works.
The overall objective of the assignment was to prepare a feasibility study for the Company, the Oblast Akimat, and the City Akimat, to be used by (i) the EBRD to appraise the Project and take a decision on the prospective financing and (ii) the Government of Kazakhstan (GOK) in approving capital grant allocation in accordance with the budget legislation of the GOK and rules of the Enhanced Partnership Framework Arrangement Programme. The feasibility study shall be in line with EBRD requirements and in line with the country’s regulatory requirements for approval of the financial and economic analysis (FEO) by the relevant state bodies, including the Ministry of National Economy of Kazakhstan as well as the Oblast Akimat, and shall be acceptable to the EBRD, the Committee of the Republic of Kazakhstan for Regulation of Natural Monopolies and Competitiveness Protection, the GOK and the Oblast Akimat (note: the FEO to be prepared as a separate document attached to overall feasibility study).
The State Communal Enterprise “Astana Su Arnasy” (the “Company”) supported by the Akimat of Astana (the “Akimat”) approached the European Bank for Reconstruction and Development (the “EBRD”) with a request to finance the priority investments in rehabilitation and modernisation of its water supply and wastewater management facilities resulting in enhanced operations efficiency, reduction in losses and improvements in environmental standards. Particular attention should be given to the increasing amounts of wastewater and excess sludge produced and the lack of alternative disposal and/or treatment for the sludge. The Company, a water distribution and wastewater treatment company, is 100% owned by the Akimat of the city of Astana. The Company is the only entity providing potable water supply services to the residents of the city of Astana (the “City’), around 850,000 inhabitants, including individual, commercial and public sector customers. The Project’s priority investment programme (the “PIP”) is estimated at around KZT 6 billion (about EUR 30 million) where the EBRD is planning to provide loan of up to KZT 5 billion (EUR 25 million). The final amount of the PIP will be finalised as a result of the Project Feasibility Study findings. The overall objective of the assignment is to prepare a Feasibility Study for the EBRD, the Company and Government of Kazakhstan (“GoK”), which the EBRD can use to appraise the Project and take a decision on the prospective financing.
